Terms and Conditions

Copyright

In order to conform to copyright legislation, before sending any image to us for printing, you must be sure that you have permission from the copyright holder to reproduce the image. We will assume that you are in conformity with the legislation in your country of residence, and will therefore not accept any responsibility for breaches of this legislation.

In the UK, all original artwork has an automatic copyright, and you will need the artist’s permission to make a reproduction. As an example, there is no issue for you to display one of my images in your home as, by selling it to you, I am authorising the reproduction. However, it is not possible to simply download a copy of Leonardo da Vinci’s “Mona Lisa”, or even a photograph from an unknown photographer unless you have purchased a licence, paid a royalty, or obtained permission to reproduce the artwork. Please see the UK Government website if in doubt – www.ipo.gov.uk. Copyright law in other countries may differ.

Use of images

Under copyright law, and on the assumption that you are in conformity with that law, you will hold the copyright to any image you supply to us for reproduction. However, Change-of-Image will hold the copyright of any image that has been enhanced or modified by us. We are therefore entitled to use such images in any advertising or promotion, but given the personal nature of many images, we will only do so after seeking your agreement.

Colour Integrity

The degree of colour integrity depends largely on your monitor, so the actual colours in the painting may differ slightly from the image appearing on your screen. However, our HP printer has a built-in spectrophotometer, which guarantees the best possible colour reproduction of the original image.

Payment in advance

We do require payment in advance, as you will appreciate that we cannot conduct extensive work with expensive materials without a commitment to purchase.

Cancellations

Cancellation of an order will be accepted within the framework of UK legislation – i.e. Consumer Protection (Distance Selling Regulations), which specify that a consumer has the right to:

- Receive clear information about goods and services before deciding to buy
- Written confirmation of goods and services ordered
- A cooling off period of seven working days in which the consumer can withdraw from the contract
- Protection from credit card fraud

Loss, Damage & Returns

In the unlikely event of the painting being damaged upon delivery, or that you are dissatisfied with the finished painting, you will be covered by our Returns Policy, which means that we will offer to reprint the image for you, or provide you with a credit equal to the purchase price of the painting in question. In either case, to qualify for the reprint or credit, we require you to notify us by email within 24 hours of receipt, and return the painting within one week of receipt, packed carefully in it’s original packing materials. The cost of return shipment will be credited to you.

If the painting is lost during shipment to you, Change-of-Image will accept full responsibility for pursuing the case with the shipper concerned. If, after a reasonable period of investigation, it appears that the shipment is irretrievably lost, Change-of-Image will supply a duplicate painting free of charge.

If you send us any non-digital prints or negatives, we regret that we cannot accept responsibility for any loss or damage. Whilst they are in our possession, however, we will treat them with the utmost care and respect.

Damage after hanging

We regret that we cannot accept responsibility for any damage to a painting that may occur after hanging, as a result of insect infestation, poor wall fixing, or damage resulting from exposure to smoke, extreme temperatures, damp, or prolonged direct sunlight.

Data Protection

We operate under the jurisdiction of the European and UK Data Protection laws, which entitle you to request us at any time to disclose any of your personal information that we may hold on our database, and which prevent us from sharing this data with any third party.
